1. The Parties

Inquirer

For the purposes of these Terms and Conditions, the Inquirer is any entity that submits an Inquiry via the www.zivnostnici.cz or www.freelancetrade.eu website.

("Inquirer")

 

2. Service description

The service is used to facilitate trade enquiries for registered suppliers. An enquiry is a request sent by an enquirer to find a suitable supplier of goods and services. The service provides contact to selected registered suppliers through the 'whishlist' tab in order to establish cooperation. The service is operated by rabog s.r.o..

Submitting an inquiry is free of charge, the Inquirer does not pay any fee to the Provider for submitting and sending it to relevant suppliers.


Terms and conditions for placing an inquiry:

The enquiry must have the contact details duly filled in and the contact details must be entered truthfully. The primary concern of the enquirer must be to find a suitable supplier to work with. The service must not be misused for market monitoring or other negative purposes. The purpose of the enquiry must not be concealed in order to offer and promote one's own goods and services.

The enquirer agrees to the publication of the enquiry and the inclusion of their contact details on the websites of the network operator rabog s.r.o. and its subsidiaries (namely zivnostnici.cz and freelancetrade.eu).
 

3. Withdrawal from the contract

 

3.1 The service provider

The service provider may withdraw from the contract if the actions of the inquirer are contrary to these terms and conditions, good morals, violate the interests of third parties, the server operator and the terms and conditions for placing an inquiry. In case of non-compliance with these obligations, the provider reserves the right to withdraw from the contract and not to send and delete the request.

 

3.2 Inquirers

The Inquirer may request the Provider to terminate the Inquiry by emailing the website www.zivnostnici.cz. An Inquiry once sent to Suppliers cannot be completed, modified or withdrawn.


4. Privacy Policy

The Service Provider collects with the consent of the enquirers their personal data, in particular name and surname, address, contact details, company name. The aforementioned data is used to facilitate business inquiries between suppliers and inquirers.


The service provider has the right to send the enquirer by e-mail, SMS and telephone commercial communications with news, special offers, advertising, etc. The enquirer has the right to unsubscribe from receiving commercial communications at the above-mentioned contacts.


The service provider transmits the personal data of the enquirer only for the purpose of facilitating business enquiries.


The enquirer may change the stored personal data at any time.

 

In accordance with the provisions of Sections 87(2) and 96(1) of Act No. 127/2005 Coll., on Electronic Communications and on Amendments to Certain Related Acts (Act on Electronic Communications), as amended, the Requestor hereby agrees to be offered marketing advertising or other offers of goods or services by the Provider via electronic communications networks or services. In accordance with the provisions of Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services and on Amendments to Certain Acts (Act on Certain Information Society Services), as amended, the Inquirer hereby further consents to the sending of information and commercial communications by the Provider related to the Provider's services or business (establishment) to the Inquirer's electronic address and to the sending of other commercial communications to the Inquirer's electronic address.

5. Final provisions

The operator does not guarantee the continuous functionality of the system, error-free operation and security of the system. By registering a company, the user unconditionally agrees to these terms and conditions. Other relationships and requirements, as well as the content of the registration, must not be in conflict with generally applicable laws and related regulations.


The subject of these terms and conditions is the regulation of contractual relations between the Provider and the Inquirer in the provision of the service - mediation of business inquiries for registered suppliers.


The contractual relationship based on these Terms and Conditions shall be established between the Inquirer and the Provider at the moment of sending an inquiry using the web form at www.zivnostnici.cz or www.freelancetrade.eu or after submitting an inquiry via telephone contact.


These terms and conditions become effective upon their publication. Rabog s.r.o. reserves the right to change the Terms and Conditions. The company will publish the change and its effectiveness in an appropriate manner on the website www.zivnostnici.cz.


These Terms and Conditions are valid and effective as of 1.1.2024.

 

 

Terms and Conditions Trades.
Introductory provisions

1.1 Service Provider

The Service Provider of www.zivnostnici.cz and www.freelancetrade.eu is rabog s.r.o., with registered office at Revoluční 1403/28, Prague 1 - Nové Město, 110 00, ID No.: 051 33 475, account number: 2801031930/2010, Registered under file number C 258136 (hereinafter referred to as "Provider").

 

1.2 Service Customer

The Customer is an entrepreneur, i.e. a natural or legal person who has an assigned identification number in the Czech Republic/Republic (hereinafter referred to as the "Customer") and who orders the service of registration and sending inquiries to zivnostnici.cz or other paid services according to the offer and price list of the Provider.


1.3. ePoptávka.cz service

The zivnostnici.cz service is used to facilitate business inquiries for the Customer. Inquiry means a structured request sent by the Inquirer in order to find a suitable supplier of goods and services. The service provides access to contacts for the purpose of establishing cooperation. The service of sending business inquiries includes access to the archive of inquiries that were published for the Customer before the service was activated. The service is operated by rabog s.r.o.


2. Registration of the Customer

2.1 Registration methods

Registration is carried out by the Customer with the Provider by telephone or e-mail or by separate registration on the Provider's website, after providing all the necessary data for concluding the contract by distance. Registration in the zivnostnici.cz and freelancetrade.eu system is binding for both parties in terms of the concluded contract.

 

2.2 Duration of service

The duration of the service starts immediately after the order has been processed (max. within 3 working days from the order). At the same time, an invoice is sent electronically. Payment is made when the payment is credited to the Provider's account. The service is terminated according to the agreed duration of performance and is not automatically extended for further periods.

 

2.3 Conclusion of the contract by telephone or e-mail by distance method

The contract between the Provider and the Customer, which is concluded by telephone or e-mail, is concluded by remote means. The Provider undertakes to conclude contracts with the Customer by telephone in accordance with the principles set out below:

The Customer is informed by the Provider's employee in the call about the monitoring of the call.

The binding nature of the telephone contract concluded remotely is based on the Customer's express consent, including consent to the price of the service sold.

The Customer shall have the right to listen to the voice recording of the concluded contract at the Provider's registered office after a prior request by e-mail to info@zivnostnici.cz or info@freelancetrade.eu and a confirmation of the date by the Provider. Sending the recording by e-mail is not possible with regard to the protection of personal data according to legal standards.

3. Withdrawal from the contract

3.1 Withdrawal by the Provider

The Service Provider may withdraw from the contract if the Customer's actions are in violation of these Terms and Conditions, good morals, if the Customer violates the interests of third parties, the Service Provider, disseminates the content of inquiries in any way without the consent of the Provider, disseminates his/her profile access data, sends unsolicited commercial communications or offers of services unrelated to the content of the inquiry (unsolicited offer), abuses the acquired contacts for fraudulent business or for committing criminal activities.

In the event of non-compliance with these obligations, the Provider reserves the right to withdraw from the contract and unsubscribe the Customer from the system, without financial compensation.

 

3.2 Withdrawal by the Customer

In the event that the Provider fails to perform the service and the Customer has informed the Provider of this fact by e-mail: info@zivnostnici.cz or info@freelancetrade.eu and the Provider has not made corrections, the Customer has the option to withdraw from the contract. The Customer accepts that the evaluation of whether or not the service is performed always refers to the entire contractual period. Due to the seasonal development of economic demand on the market, the Provider does not guarantee the number of business opportunities sent.

In the event that the complaint is justified, which the Provider will comment on within 30 days after the complaint has been submitted, the Provider is obliged to refund a pro rata part of the registration fee (in proportion to the total period of service performance) upon termination of the service.

In the event that the Customer wishes to cancel the already ordered service and thus withdraw from the concluded contract, this can be done within 2 working days of the service order. In this case, the Customer is obliged to pay the Service Provider a cancellation fee of 50% of the service amount.

 

4. Description of services

4.1 Sending enquiries

By registering on the zivnostnici.cz and freelancetrade.eu server, the Customer gains access to the contacts of the requesters in the Provider's system's industry categories. Inquiries from selected fields in combination with keywords will be sent to the Client directly to the e-mail address provided immediately after their publication. The Customer does not pay any commission to the Provider for the transactions made. The registration includes the inclusion of the Client's profile in the catalogue of suppliers and in the catalogue of companies of the rabog s.r.o. network.


4.3 Other rabog.cz services

Bazaar service

The Bazaar service is used to present the offers of both Requesters and Orderers. Anyone can place an advertisement with goods for sale. The section may not be used for the purpose of hidden offers and promotion of own goods and services.

 

5. Privacy Policy

With the consent of the Customer, the Service Provider collects the Customer's personal data in the form of call recordings and in written or e-mail form, in particular name and surname, address, contact details, company name. The Customer further agrees that the provided data of a public nature are published in the catalogues of suppliers operated by Rabog s.r.o. The above information is used for the purpose of facilitating business enquiries. The Customer agrees to the recording of calls made for the purpose of concluding the contract, service activities within the service and also in the context of improving the quality of the services provided.


The Service Provider has the right to send the Customer by e-mail, SMS and telephone commercial communications with news, special offers, advertising, etc. The Customer has the right to unsubscribe from receiving commercial communications at the above-mentioned contacts.

 

After the expiry of the Customer's registration in the www.zivnostnici.cz and freelancetrade.eu system, the Provider has the right to keep the Customer's contact details for its internal needs, unless the Customer requests their deletion.


The Service Provider transmits the Customer's personal data only for the purpose of facilitating business enquiries.


The stored personal data can be changed at any time by the Customer or the enquirer in their customer profile or via the above-mentioned contacts.

 

In accordance with the provisions of Sections 87(2) and 96(1) of Act No. 127/2005 Coll., on Electronic Communications and on Amendments to Certain Related Acts (Act on Electronic Communications), as amended, the Customer hereby agrees to be offered marketing advertising or other offers of goods or services by the Provider via electronic communications networks or services. The Customer hereby agrees, in accordance with the provisions of Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services and on Amendments to Certain Acts (Act on Certain Information Society Services), as amended, to the sending of information and commercial communications by the Provider related to the Provider's services or business (plant) to the Customer's electronic address and to the sending of other commercial communications to the Customer's electronic address.

6. Final Provisions

The Provider does not guarantee the continuous functionality of the system, error-free operation and security of the system. By registering the Customer's company, the Customer unconditionally agrees to these terms and conditions. Other relationships and details, as well as the content of the registration, must not be in conflict with generally applicable laws and related regulations.


The subject of these Terms and Conditions is the regulation of contractual relations between the Provider and the Customer in the provision of the service.


The contractual relationship based on these Terms and Conditions shall be established between the Provider and the Customer at the moment of a duly concluded contract by means of distance (by telephone, e-mail or via the Provider's website). By entering into such a contract, the Customer confirms that he/she agrees to these Terms and Conditions.


These terms and conditions become effective upon their publication. Rabog s.r.o. reserves the right to change the Terms and Conditions. The company will publish the change and its effectiveness in an appropriate manner on the websites www.zivnostnici.cz and www.freelancetrade.eu.


These Terms and Conditions shall be valid and effective from 1 January 2024.
